By accessing or using the Service in any manner, including, but not limited to, visiting or browsing the Website or downloading the mobile application, you agree to be bound by these Terms.

Acceptance of Terms

By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, including any future modifications. If you do not agree to these Terms, you must not use the Service. We reserve the right to change or modify these Terms at any time, and you agree that your continued use of the Service following such changes signifies your acceptance of the updated Terms.

Service Description

WP Order Alerts is a comprehensive service designed to streamline the management of WooCommerce stores by providing real-time order notifications and various management tools. The Service includes, but is not limited to:

  • Real-Time Order Alerts: Instant notifications are sent directly to your mobile device whenever a new order is placed, allowing you to take immediate action.
  • Multi-Store & Team Management: Manage multiple WooCommerce stores from a single dashboard, with the ability to assign custom permissions to team members for secure and efficient operations.
  • Reporting: Access detailed WooCommerce reports on your mobile device, enabling you to make informed, data-driven decisions without needing to log into the WordPress dashboard.
  • Insights: View concise, actionable insights into your store’s performance, helping you optimize your operations and increase revenue.
  • Notification Builder: Customize the content of your notifications, allowing you to focus on the most relevant information.
  • Audit Log: Maintain accountability with a detailed log of all actions taken within the app, including viewing orders, changing statuses, and more.
  • Order Management: Centralize your order management process, allowing you to update statuses, print invoices, share order details, and more—all from one platform.

Additional features and add-ons may be made available for an additional fee.

Eligibility

The Service is intended for users who are at least 18 years old. By using the Service, you represent and warrant that you meet this eligibility requirement. If you do not meet this requirement, you must not use the Service.

Account Registration

To access certain features of the Service, you must create an account. During registration, you agree to provide accurate, current, and complete information about yourself as prompted by the registration form. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

Subscription Plans and Fees

WP Order Alerts offers both free and paid subscription plans. The details of the available plans, including current pricing, are provided on our Pricing Page.

  • Free Plan: This plan provides basic features, including a limited number of notifications and access to insights for one site.
  • Entrepreneur Plan: This paid plan includes unlimited notifications, advanced insights, full access to the Notification Builder, Audit Log, and the ability to add sub-users and manage multiple sites.

In addition to the base pricing for the Entrepreneur Plan, certain add-ons may be available for an additional charge. These add-ons currently include, but are not limited to:

  • Additional Sites: Add and manage extra WooCommerce stores within your account.
  • Additional Users: Add sub-users with custom permissions for team management.

All fees for the base plan and any selected add-ons are non-refundable, except as required by law.

Billing and Payment

By subscribing to a paid plan, you agree to pay the applicable subscription fees and any related charges as outlined on our Pricing Page. Subscription fees are billed on a recurring basis according to the billing cycle you select at the time of purchase (monthly or annual). Payments will be charged to the payment method provided at the time of registration or as updated in your account settings.

7-Day Free Trial

New users are eligible for a 7-day free trial of the Entrepreneur Plan. The trial period allows you to experience the full features of the Entrepreneur Plan at no cost. If you do not cancel your subscription before the end of the 7-day trial period, your account will automatically convert to the Entrepreneur Plan, and you will be billed the monthly subscription fee. You may cancel the trial at any time during the 7-day period without incurring charges.

Cancellation and Termination

You may cancel your subscription at any time by accessing your account settings. Upon cancellation, you will continue to have access to the paid features until the end of your current billing cycle, after which your account will revert to the Free Plan or be deactivated if no free plan is available.

WP Enhanced reserves the right to suspend or terminate your account at our discretion, without prior notice, if we believe you have violated these Terms, engaged in fraudulent activity, or are otherwise misusing the Service. Upon termination, your right to use the Service will immediately cease, and any data associated with your account may be deleted.

Use of the Service

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Service in any manner that could disable, overburden, damage, or impair the Service, or interfere with any other party’s use of the Service.
  • Attempt to gain unauthorized access to any part of the Service or any systems or networks connected to the Service.
  • Use any automated means, including robots, scripts, or spiders, to access or use the Service.

Intellectual Property

All content, features, and functionality (including but not limited to text, graphics, logos, and software) available through the Service are the exclusive property of WP Enhanced and are protected by copyright, trademark, and other applicable laws. You may not reproduce, distribute, modify, or create derivative works of any content without our express written permission.

Mobile Applications

The Service’s mobile application is available on the Google Play Store and the Apple App Store (iOS version). You acknowledge that the availability of the mobile application is dependent on the third-party platform from which you downloaded the application, such as the Google Play Store or the Apple App Store (“App Store”).

You agree to comply with all applicable third-party terms of agreement when using the mobile application, including but not limited to any terms and conditions set by the App Store.

We do not guarantee that the mobile application will be available at all times, or that it will work with all devices or operating systems. Updates to the app or the operating systems on your device may affect the functionality of the mobile application.

Additionally, you acknowledge that your use of the mobile application is subject to the availability and functionality of the App Store, and we are not responsible for any issues, including delays or failures in the delivery of updates, that may arise from the App Store.

Data Privacy and Security

Your use of the Service is also governed by our Privacy Policy, which is incorporated by reference into these Terms. The Privacy Policy outlines how we collect, use, and protect your personal information. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.

  1. User Data: We are committed to protecting the privacy and security of our users. As part of our operations, we collect minimal user data, which includes but is not limited to, your Name, Email Address, and an Encrypted Password. It’s important to note that we do not store detailed WooCommerce order details. However, for operational purposes, we log order IDs. This practice is crucial for facilitating order tracking, customer service, and enhancing your user experience.
  2. Third-Party Services: In our effort to offer enhanced functionalities, we partner with third-party service providers. For instance, we utilize OneSignal for sending notifications. Users are identified within OneSignal by device ID and WPOA Account ID. As our valued user, you are encouraged to review OneSignal’s privacy policy to understand their data handling practices. Please be aware that we do not control the privacy practices of our third-party partners.

Modifications to the Service and Terms

WP Enhanced reserves the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice. We may also revise these Terms from time to time. Continued use of the Service after such changes will constitute your acceptance of the revised Terms. We encourage you to review these Terms periodically to stay informed of any updates.

Marketing Communications

By creating an account with WP Order Alerts, you agree to receive marketing emails and other communications from us related to the Service. You may opt out of receiving these communications at any time by updating your preferences on your profile page or following the unsubscribe link in the email communications.

Service Dependencies and Notification Delivery

Our services, including notification delivery, depend on the operational functionality of third-party services such as OneSignal and the WooCommerce API. Changes made by WooCommerce to their API or any disruptions in their service may impact the functionality of our Service and the timely delivery of notifications. Additionally, the successful receipt of notifications is contingent upon your access to either internet or cellular service.

We endeavor to ensure timely and accurate delivery of notifications. However, we shall not be held responsible for missed notifications or service disruptions due to reasons beyond our control, including but not limited to third-party service failures, connectivity issues, or changes made to the WooCommerce API.

Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis. WP Enhanced makes no warranties, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, nor do we make any warranty as to the results that may be obtained from the use of the Service.

Limitation of Liability

General Disclaimer: We strive to ensure that our services, including the delivery of notifications via third-party services like OneSignal, are executed in a timely and accurate manner. Despite our efforts, certain factors outside our control may affect the performance and reliability of these notifications. These factors include but are not limited to operational issues with third-party services, and users’ access to internet or cellular services.

Limitations on Our Responsibility: We shall not be liable for any damages, losses, or inconveniences suffered by users as a result of missed notifications or any disruptions in the service caused by:

  1. Third-Party Service Failures: Failures, outages, or disruptions in the services provided by third parties, including OneSignal. While we select our third-party service providers carefully, we cannot guarantee their uninterrupted operation.
  2. Connectivity Issues: Users’ lack of access to necessary internet or cellular services required for the receipt of notifications. It is the user’s responsibility to ensure they are in an area with adequate connectivity to receive notifications.
  3. Operational Limitations: Any limitations inherent to the technology used for delivering notifications. This includes limitations related to device compatibility, operating system restrictions, or user settings that may prevent the successful delivery of notifications.

Scope of Liability: In no event will we, or our directors, employees, or agents, be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of our services, any content delivered to you through our services, or your inability to receive notifications, whether based on warranty, contract, tort (including negligence), or any other legal theory, and whether or not we have been informed of the possibility of such damage.

User Acknowledgment: By using our services, you acknowledge and agree to this limitation of liability and assume full responsibility for any risks associated with your use of our services, including the receipt of notifications through third-party services.

Governing Law

These Terms and any disputes arising out of or related to these Terms or the Service shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law principles. You agree to submit to the personal jurisdiction of the courts located in the United Kingdom for the purpose of litigating any such disputes.
